September 8, 2022 Opinion or Order Filing 19 ORDER: The Court dismisses Plaintiff's claims for damages and injunctive relief under 42 U.S.C. 1983 against the State of New York under the doctrine of Eleventh Amendment immunity, for lack of subject matter jurisdiction and because Plaintiff seeks monetary relief from a defendant that is immune from such relief. Fed. R. Civ. P. 12(h)(3); see 28 U.S.C. 1915(e)(2)(B)(iii). The Court dismisses Plaintiff remaining claims for damages and injunctive relief under Section 1983 against the individual defendants under the Heck favorable-termination rule, for failure to state a clam on which relief may be granted, see 1915(e)(2)(B)(ii), but without prejudice to Plaintiff's reassertion of those claims after Plaintiff has been granted habeas corpus relief, or other relief, that would invalidate his current incarceration. The Court construes, for the purpose of this order, Plaintiff's remaining claims in which he seeks his release from incarceration and his restoration to parole as claims for habeas corpus relief under 28 U.S.C. 2254. In the interest of justice, the Court directs the Clerk of Court to transfer those claims for Section 2254 habeas corpus relief to the United States District Court for the Northern District of New York. See 28 U.S.C. 1406(a); 2241(d); Local Civil Rule 83.3. The duty to allow Plaintiff the opportunity to withdraw his claims for Section 2254 habeas corpus relief before proceeding further, see Cook, 321 F.3d at 282, and any determinations as to whether such claims are timely, see 28 U.S.C. 2244(d), and whether Plaintiff has exhausted the available state-court remedies with regard to such claims, or is required to do so, see 2254(b)(1), rests with the transferee court. This order closes this action in this court. Because the Plaintiff makes no substantial showing of a denial of a constitutional right, a certificate of appealability will not issue from this Court. See 28 U.S.C. 2253. The Court certifies under 28 U.S.C. 1915(a)(3) that any appeal from this order would not be taken in good faith, and therefore IFP status is denied for the purpose of an appeal. August 17, 2022 Opinion or Order Filing 17 ORDER GRANTING IFP APPLICATION IN PRISONER CASE: The Clerk of Court is directed to send a copy of this order and the prisoner authorization to the agency having custody of Plaintiff. That agency is directed to forward copies of Plaintiff's prison trust fund account for the past six months and to disburse the payments required under 28 U.S.C. 1915 to the United States District Court for the Southern District of New York and to include the above docket number on the disbursement before sending it to the Court. June 21, 2022 Opinion or Order ORDER TRANSFERRING CASE: On February 28, 2022, plaintiff filed a form civil rights complaint against the State of New York, Regional Director of the Bronx Region Parole Office Rodney Young, The Chairwoman of the Board of Parole Tina Stanford, Parole Officer Lewis Robinson, and two parole officials known as Ms. Charvey and Ms. Clayborn. See Compl. 2-3 (ECF Pagination) Dkt. #1 ). Following a parole revocation, see id.at 16, plaintiff was incarcerated at Downstate Correctional Facility, see id. at 4. That facility is in Dutchess County, within the Southern District of New York. Plaintiff is now incarcerated at the Marcy Correctional Facility, see id. at 1, in Oneida County, within the Northern District of New York. Plaintiff alleges that defendants are wrongly keeping him past his conviction date. Id. at 3-5. Under 28 U.S.C. 1391(b), a civil action may be brought in "(1) a judicial district in which any defendant resides, if all defendants are residents of the State in which the district is located; (2) a judicial district in which a substantial part of the events or omissions giving rise to the claim occurred, or a substantial part of the property that is the subject of the action is situated; or (3) if there is no district in which an action may otherwise be brought as provided in this section, any judicial district in which any defendant is subject to the court's personal jurisdiction with respect to such action." 28 U.S.C. 1391(b)(1)-(3). Plaintiff has not pleaded the residence of any of the defendants, and the addresses that he lists for those defendants are outside the Eastern District of New York. See Compl. And plaintiff has not alleged that a substantial part of the events or omissions giving rise to this claim occurred within the Eastern District. See ibid. However, since plaintiff alleges that the events giving rise to his claim occurred at Downstate Correctional Facility, which is in the Southern District of New York, venue would be proper in that district pursuant to Section 1391(b)(2). Accordingly, transfer of this action to the Southern District of New York is appropriate. See 28 U.S.C. 1406(a). The Clerk of Court is hereby directed to transfer this action to the United States District Court for the Southern District of New York. 28 U.S.C. 1391(b); 1406(a). A decision on Plaintiffs request to proceed in forma pauperis and his request for counsel is reserved for the transferee Court. The provision of Rule 83.1 of the Local Rules of the Eastern District of New York which requires a seven-day delay is waived. Ordered by Judge Rachel P. Kovner on 6/21/2022.
