TEXT ORDER: On December 28, 2022, plaintiff filed a second IFP application. Dkt. No. #6 . The IFP application was certified by an authorized officer at the Richmond Justice Center. Id. at 2. However, the envelope, containing a postmark of December 22, 2022, indicates that the application was mailed from New York, NY with plaintiff's address as 111 John Street, 9th Floor, New York, New York, 10038. Id. at 3. Upon receipt of the IFP application, the Court issued an Order reopening this matter and mailed a copy of the Order to plaintiff at his address of record; Richmond City Jail, 1701 Fairfield Way, Richmond, VA 23223. Dkt. No. 7. On January 23, 2023, the mailing was returned to the Court as undeliverable with the notation "return to sender - not at this address". Dkt. No. #8 . Under this court's rules, an unrepresented litigant is under a duty to inform the court of any address changes IN WRITING. See N.D.N.Y.L.R. 10.1(c)(2). For the orderly disposition of cases, it is essential that litigants honor their continuing obligation to keep the court informed of address changes. Consequently, plaintiff is advised that he must file a change of address within THIRTY DAYS, and he must continue to submit any address changes to the court as long as his action is pending. "Failure to notify the Court of a change of address in accordance with L.R. 10.1(c)(2) may result in the dismissal of any pending action." N.D.N.Y. L.R. 41.2(b). The Clerk serve a copy of the Order reopening this matter (Dkt. No. 7), this Order and a Change of Address Form on plaintiff at his last known address, and address provided with the IFP application.
