They have violated federal law and deprived the hospital of tens of millions of dollars that would have been used to expand and improve patient care in the community. Not one penny of those excess payments has resulted in any additional benefit to NYU Hospital's employees. See First Amended Complaint 49 (letter from 1199 president stated that NYU Hospital was paying tens of millions of dollars into the Benefit Fund for "exactly the same health benefit coverage" for its employee "with no offsetting benefit"). Neither the CBA nor the amendments to that agreement require NYU Hospital to arbitrate a claim that the imposition of such punitive obligations, which do not arise under the CBA, violate the law. The Court should allow this case to proceed promptly in litigation.
