It is now hereby ORDERED as follows: All bonds subject to the settlement and funds transferred to and held by the escrow agent pursuant to the settlement agreement in this action (the "Brecher class action") shall be deemed and considered to be in custodia legis of the Court, shall not be subject to attachment, execution, or restraint by any creditor of Argentina or by any other person, and shall remain subject to the jurisdiction of the Court, until such time as such funds shall be distributed and the bonds cancelled pursuant to the settlement agreement. May 24, 2017 Opinion or Order Filing 150 FINAL JUDGMENT in favor of The individual persons and entities listed in Annex A, A Beccara, Giovanna, et al, Henry H. Brecher against Republic of Argentina: For the reasons set forth in the Court's April27, 2017 Opinion and Order [ECF No. 148], it is hereby ORDERED, ADJUDGED, AND DECREED as follows: 1. This action is dismissed on the merits with prejudice as to all class members and, except as explicitly provided for in the settlement agreement dated May 23, 2016 [ECF No. 108-1], without costs. 2. Class members are permanently enjoined and barred from instituting or pursuing any claims subject to the settlement agreement or seeking additional recovery payable to a class member based on the facts or transactions alleged in the complaint. 3. A judgment is entered in the amount up to 2,779,800.1 To satisfy the judgment, the Republic of Argentina shall on the payment date pay to the escrow agent 150% of the outstanding principal amount of the bonds owned and delivered for cancellation by the class members to the escrow agent at least seven days prior to the payment date, as set forth in the settlement agreement. To satisfy this judgment, the Republic shall not be required to make any payments for bonds that have not been delivered to the escrow agent or otherwise presented by no later than seven days prior to the payment date. 4. Without affecting the finality of this Final Judgment in any way, the Court expressly retains exclusive jurisdiction over this action to consider all further matters arising out of or connected with the settlement, its administration, and its consummation, including to enforce, administer, and ensure compliance with all terms of the settlement agreement dated May 23, 2016, the Order Granting Final Approval of Class Settlement, and this Final Judgment. January 24, 2017 Opinion or Order Filing 142 ORDER: On November 10, 2016, the court held a fairness hearing in the above captioned cases to address proposed settlements. At the fairness hearing, plaintiffs requested an extension of the deadline for submission of class members' claims and documentation to the Republic of Argentina. The court extended the deadline to November 15, 2016.The court now invites plaintiffs in these cases to file an updated list of claims submitted, and the corresponding anticipated value of the class fund and attorneys' fees requests. June 20, 2016 Opinion or Order Filing 117 SECOND AMENDED AND SUPPLEMENTAL ORDER OF APPOINTMENT OF SPECIAL MASTER: The Order for Appointment of Special Master, June 23, 2014, as amended and supplemented by the Amended and Supplemental Order of Appointment of Special Master, November 3, 2014, is further amended and supplemented as follows: 1. From and after April 22, 2016, Elliot Capital Management and Aurelius Capital Management, who have settled their claims with the Republic of Argentina, shall have no further responsibility for the fees and expenses of the Special Master. 2. From and after April 22, 2016, those parties who avail themselves of the services of the Special Master in negotiations with the Republic of Argentina shall have responsibility for their share of the fees and expenses of the Special Master. 3. The Special Master shall have the right to invoice the clients of Morgan Lewis & Bockius and Duane Morris for his services from April 22, 2016 through June 22, 2016 (and for services thereafter as the Special Master may determine appropriate) by invoicing the law firms as the representatives of their clients. These clients shall include Attestor Master Value Fund LP; Bybrook Capital Master Fund LP; Hazelton Master Fund LP; Trinity Investments Limited; White Hawthorne, LLC; and White Hawthorne II, LLC. Unless otherwise agreed between and among these clients, each shall be responsible for an equal share of one-half of the Special Master's fees and expenses. The Republic of Argentina shall remain responsible for its one-half of the Special Master's fees and expenses. 4. This Order shall apply to the above-captioned cases, all of which remain open, as well as any other cases against the Republic of Argentina in which the parties avail themselves of the services of the Special Master. 5. May 25, 2016 Opinion or Order Filing 110 ORDER: On May 23, 2016, plaintiffs in the Seijas and Brecher class actions filed motions for preliminary approval of settlement. In the memoranda in support of their motions, plaintiffs briefly address the issue of an additional opt-out period under Federal Rule of Civil Procedure 23(e)(4). Plaintiffs submit that the court should not permit an additional opt-out period. See Seijas Mem. L. 11; Brecher Mem. L. 13-14. If the court were inclined to permit an additional opt-out period, however, the Seijas plaintiffs "request the opportunity to be heard more fully on the issue, including on potential mechanics" that could "minimize or avoid the risk of free-riding." Seijas Mem. L. 11. The court is considering whether to permit an additional opt-out period. Plaintiff is invited to submit a memorandum, limited to three pages, by 5:00 p.m. tomorrow on the issue of whether the court should permit an additional opt-out period. The memorandum may also suggest potential mechanics that could minimize or avoid the risk of free-riding. The court has also invited plaintiffs in the Seijas class actions to submit a memorandum. That same day, counsel to the eight plaintiff classes in the Seijas class actions also notified the court that settlements in principle had been reached with the Republic to settle those cases. Accordingly, both counsel requested an adjournment of tomorrow's evidentiary hearing. This adjournment is to give the parties time to finalize the written settlement agreements and submit motions for preliminary approval of the settlements. They have also agreed to take the following actions: 1. The class action plaintiffs shall disseminate the form to a list of potential class members maintained by Gilardi & Co. 2. The class action plaintiffs shall provide the form to DTC, Euroclear, and Caja de Valores, and request dissemination of the form through the mechanisms those entities maintain. If, after engaging with DTC, Euroclear, and Caja de Valores, the class action plaintiffs believe that assistance from the Republic of Argentina is needed to implement these mechanisms, counsel for the class action plaintiffs and the Republic of Argentina shall meet and confer, and will present any unresolved issues to the court for determination. 3. The class action plaintiffs shall issue a press release over Businesswire at least twice. This press release shall alert bondholders to contact counsel for the class action plaintiffs to obtain a proof-of-claim form. August 30, 2012 Opinion or Order Filing 70 ORDER: On March 27, 2009, a plaintiff class was certified in this case. Plaintiff now moves for summary judgment on liability and damages.As stated on the record at the hearing held on August 29, 2012, defendant does not object to the entry of summary judgment on the issue of liability. Plaintiffs motion for summary judgment of liability is granted. Judgment will be entered on the Republic of Argentina's liability for the beneficial interests held by the class in the bond, ISIN XS0113833510, denominated in Euros with a coupon rate of 9.25% and a maturity date of July 20, 2004. However, for the reasons discussed on the record at the hearing held on August 29, 2012, plaintiffs motion for summary judgment of damages is denied.
