November 29, 2007	Filing 82 ORDER The Court has reviewed the plaintiffs' supplemental brief regarding the designation of charities to receive Cy Pres Fund contributions. While the court agrees that the American Red Cross is an eminently worthwhile charity, I believe it would be more in keeping with the cy press doctrine to provide a benefit more closely related (albeit indirectly) to the interests of the class. As the class consists of book readers, I propose that the third beneficiary of the Cy Pres Fund be Reach Out and Read of Greater New York. The parties are requested to advise the Court by 12/10/07 whether they request the Court to reconsider its preliminary decision to designate Reach Out and Read of Greater New York as the third beneficiary of the Cy Pres Fund.
