STIPULATION AND ORDER OF DISMISSAL WITH PREJUDICE: Pursuant to Rules 41(a)(1)(ii) and 41(c) of the FRCP, this action is dismissed in its entirety with prejudice and each party shall bear its own costs and attorneys' fees. The parties have settled all disputes existing between them with respect to this action. This Court shall retain exclusive jurisdiction of this matter to enforce the obligations of the parties under the terms of their confidential settlement agreement. It is further ordered, that this Court has jurisdiction over the parties, and the subject matter of the action. this Court shall retain jurisdiction to the extent necessary to enforce this injunction, and the confidential Settlement Agreement seperately entered into between the parties, and to determine any issues that may arise under either.
