OPINION AND ORDER. Plaintiff has pled sufficient facts to demonstrate successor liability on any number of theories. As such, Verox Technologies' motion to dismiss is DENIED. The parties are reminded, pursuant to the Pretrial Scheduling Order, that the dispositive motion deadline passed on June 30, 2010, and trial is scheduled for September 2010.
