OPINION AND ORDER. For the reasons provided in this opinion and order, Defendants' motions to dismiss are GRANTED. Because Plaintiff's complaint is dismissed, Spar's and Fleet's crossclaim for indemnification or contribution from HMM is also dismissed as moot.
