Filing 63 OPINION & ORDER: Judge Cott's Report and Recommendation (Dkt. 48) is adopted in its entirety. The defendants' motion to dismiss the Second Amended Complaint is granted; Klein's cross-motion for a declaratory judgment and preliminary in junction is denied; and Klein's application for appointment of pro bono counsel is also denied. Additionally, Klein's submission in response to the Report and Recommendation, which the Court has construed as a motion to further amend the Se cond Amended Complaint, is denied as futile.The Clerk of Court is directed to terminate the motions at docket numbers 24, 28, 33, 37, and 38.
