MEMORANDUM OPINION AND ORDER re: 13 MOTION for Judgment on the Pleadings filed by Jose Santos, 15 CROSS MOTION for Judgment on the Pleadings filed by Michael James Astrue. The Court has considered all of the arguments of the parties. To the exte nt not specifically addressed above, the remaining arguments are either moot or without merit. The Court declines to follow the Report and Recommendation of the Magistrate Judge. The plaintiffs motion for judgment on the pleadings is granted to the e xtent that this case is remanded to the Commissioner for further proceedings consistent with this Opinion, and the Commissioners motion for judgment on the pleadings is denied.
