OPINION AND ORDER re: 19 CROSS MOTION for Summary Judgment filed by Century Surety Company, 11 MOTION for Judgment on the Pleadings filed by Garsch Garage Corporation. For the foregoing reasons, Garsch's motion for judgment on the pleadings is GRANTED and Centurys motion for summary judgment is DENIED. The Clerk of Court is directed to close the motions at docket entry numbers 11 and 19. Moreover, as the suit sought a declaration of non-coverage, together with costs incurred in the underlying lawsuit, and the Court has instead determined that coverage is required, any claims against the other Defendants are moot; accordingly, the Clerk of Court is directed to close the case. (Signed by Judge J. Paul Oetken on 7/30/2013) (tro)
