OPINION AND ORDER: The court thus finds that New York law governs the aspects of plaintiffs fraud claims relating to joint and several liability and apportionment of fault. If a jury finds at trial that Credit Suisse and Poulsen each committed fraud that caused plaintiffs losses, then under New York law Credit Suisse will be liable, as to plaintiffs, for 100% of Poulsens share.
