Filing 26 OPINION AND ORDER: For the foregoing reasons, the plaintiffs' motion to stay the arbitration is granted until a final decision on alter ego status is reached. If, after discovery and a consideration of the evidentiary submissions, issues of fact remain, a trial must be held to determine whether Global and Besch are alter egos of Access. Defendant's cross motion to compel arbitration is denied with leave to renew. The Clerk of the Court is directed to close the instant motions (Docket Nos. 2 and 15). A conference to set a discovery schedule is set for September 24, 2013 at 4:30 p.m. So Ordered (Signed by Judge Shira A. Scheindlin on 8/29/2013) (js) |
