Petitioner Jose Alfaro, proceeding pro se, petitions for a writ of habeas corpus pursuant to 28 U.S.C. § 2254, challenging his Ne w York State conviction for robbery and assault. Magistrate Judge Gabriel W. Gorenstein issued a Report and Recommendation (the "Report") recommending denial of the Petition. Dkt. 16. (As further set forth in this Order.) The Court adopts the Report and Recommendation in its entirety. Accordingly, the petition for a writ of habeas corpus is denied, and the action is dismissed with prejudice. As the Petition makes no substantial showing of a denial of a constitutional right, a certificate of appealability will not issue. 28 U.S.C. § 2253(c)(2).
