IT IS HEREBY STIPULATED AND AGREED by and between the parties and/or their respective counsel as follows: The parties hereby agree that the above-captioned action is dismissed and discontinued with prejudice, as to the named defendants, pursuant to Rule 41(a) of the Federal Rules of Civil Procedure. Any and all of the claims for damages by plaintiff which are the subject of this action or otherwise arise out of any of the incidents alleged in the Complaint are hereby settled, as against the named defendants, for the sum of ONE HUNDRED TWENTY FIVE THOUSAND DOLLARS ($125,000.00) in full satisfaction of all claims for damages, costs, disbursements and legal fees. ORDER: Plaintiff's counsel is seeking discovery and production of files, records, progress notes and other documents maintained by defendants relating to the foster care placement of the named plaintiff as it is alleged such records are relevant to the prosecution of the within lawsuit, and the records being of a confidential nature and prohibited from disclosure by Social Services Law Section 372 without notice and a fair hearing to all interested persons, AND FURTHER Plaintiff's counsel is seeking disclosure of Administration for Children's Services and Little Flower Children and Family Services case files and foster parent files, as it is alleged such records are relevant to the prosecution of the within lawsuit, and the records containing privileged and confidential information, IT IS HEREBY ORDERED that this Court will conduct a hearing on August 14 at noon in Courtroom 21A at the U.S. Courthouse, 500 Pearl Street, New York, New York 10007 to determine whether these records or portions thereof are relevant and necessary for the prosecution of this action, and whether this Court will order production by defendants to plaintiff's counsel. ORDERED that defendants' counsel shall give notice by serving a copy of this Order on all non-party family members and foster parents whose addresses are known to defendants or contained within these files by certified mail, return receipt requested. ORDERED that any person or his/her attorney who will appear in response to this Order must file and serve any responding affidavits, affirmations or supporting papers by August 7, 2014.
