April 10, 2018 Opinion or Order Filing 255 ORDER: The Court is in receipt of plaintiff's motion (ECF No. 246) and third-party Coca-Cola's ("Coke") request (ECF No. 253) to seal this Court's Daubert opinions (ECF Nos. 191 and 229) and its forthcoming summary judgment decision, and to replace the publicly-filed versions with redacted versions. Plaintiff and Coke argue that the decisions include sensitive information about spending as well as trade secret information. The parties collectively propose redacting terms such as the names of projects and terms that describe, very generally, the goal of various projects at the companies. This lawsuit, filed by ScentSational, alleges, inter alia, that defendants publicly disclosed plaintiff's trade secrets in their patent applications. If this is in fact the case, then there should be no need to redact the opinions to remove trade secret information, as the trade secrets have already been publicly disclosed in patents. And of course, if this is not the case and the trade secrets have not already been publicly disclosed, then plaintiff cannot support a claim against defendants. The Court has reviewed the Pepsi patents at issue, and believes that the terms plaintiffs would like to redact are in fact disclosed in Pepsi's patents. Accordingly plaintiff is directed to file a letter on the docket of no more than five pages not later than April 13, 2018 explaining its rationale for arguing that the Court's opinions should be redacted. Any other party wishing to weigh in must do so by that same deadline; plaintiff is directed to inform Coke of this Order within twenty-four hours of its issuance. (Signed by Judge Katherine B. SAND AND MR. HOEBERLEIN; terminating #226 Motion. ENDORSEMENT: Ordered. Having considered this motion for reconsideration and the opposition thereto, it is hereby DENIED. The Court has an obligation to act as a gatekeeper with regard to expert testimony--and it has done so here. An expert's qualifications are always a question for the Court--hence the requirement that a Court "qualify" an expert as part of trial testimony. Here, the issue was implicit is the overall deficiencies of the Sand report--She lacked a coherent methodology and stepped well outside her boundaries with the vast bulk of her report. In part, this demonstrated and elucidated the lack of qualification. But ultimately, the lack of a coherent, testable methodology is enough to exclude on its own. The Court has considered plaintiff's motion to preclude opinions and testimony of Dr. Hotchkiss. Dr. Hotchkiss is plainly highly qualified in the area directly relevant to his opinions.
