August 22, 2016 Opinion or Order Filing 153 MEMORANDUM AND ORDER. For the reasons above, Columbia is entitled to summary judgment on its declaratory judgment claim. The Court declares that in the event of a buyout, all reserve funds posted as of March 31, 2013, would be applied to the pending claims for which they were posted, and not refunded to Neighborhood. Neighborhood's bad faith counterclaim is dismissed. The parties are ordered to submit a joint letter to the Court regarding the status of any remaining claims and a proposal for further scheduling of the case on or before September 2, 2016. January 15, 2016 Opinion or Order Filing 151 ORDER. By letter dated August 27, 2015, plaintiff seeks to preclude defendant from offering certain damages evidence in connection with its counterclaim. Because I conclude that all the relevant factors warrant the result, defendant is precluded from relying upon or offering evidence in support of its contention that its inability to access its self insured retention surplus has lead to a loss of members that is so severe that defendant's existence is threatened. June 29, 2015 Opinion or Order Filing 99 MEMORANDUM AND ORDER. For all of the foregoing reasons, although the Court will not consider for the purposes of this motion the extraneous documents Neighborhood Risk submitted, Columbia's motion to strike is DENIED. Neighborhood Risk's mo tion to dismiss is also DENIED. This resolves Docket Nos. 64 & 79. Discovery on this motion having closed, see Dkt. No. 93, the parties shall submit a joint letter by June 15, 2015, indicating whether either or both parties intend to move for summary judgment. If either party intends to so move, any such motion must be filed, along with supporting memoranda and materials, by July 15, 2015. Responses shall be filed by July 29, 2015, and replies by August 5, 2015. If neither party intends to move for summary judgment, the parties are to indicate in their joint letter (1) the estimated length of trial; (2) dates that the parties are available for trial; and (3) a proposed schedule for submission of pretrial materials.
