March 5, 2019 Opinion or Order Filing 214 OPINION & ORDER re: 198 MOTION for Attorney Fees . filed by Rosanna Mayo-Coleman. Plaintiff's motion for attorney's fees in connection with her success at trial is GRANTED with the following modifications: (1) Attorney Gabr ielle Vinci's hourly rate is reduced from $350 to $250 an hour; (2) the paralegal hourly rate is reduced from $125 to $75 an hour; and (3) a 5% reduction in total hours billed is applied to account for Plaintiff's vague entries. As such, Plaintiff's award is reduced from $378,630 to $334,742. Plaintiff's application for costs is GRANTED without modification. Accordingly, the Clerk of the Court is directed to close the motion at Dkt. 198 and enter judgment awarding Plaintiff $334,742 in fees and $24,940.34 in costs in connection with her success in this action. June 5, 2018 Opinion or Order Filing 195 OPINION & ORDER re: 183 MOTION to Correct Judgment . filed by Rosanna Mayo-Coleman, 181 MOTION for New Trial as to Damages or, in the Alternative, for a Remittitur of Damages Awarded to Plaintiff. filed by American S ugars Holdings Inc. The Court GRANTS Plaintiff's motion to conform the verdict, GRANTS Defendant's request to remit the compensatory damages, and DENIES Defendant's request to vacate or remit the punitive damages. The Court adjusts Plaintiff's damages as follows: $500,000 in compensatory damages under the NYSHRL, $1 in compensatory damages under Title VII, and $299,999 in punitive damages under Title VII, for a total of $800,000 in damages. Plaintiff may elect either to accept these amounts or to proceed to a new trial on damages. Plaintiff has 30 days from the date of this order to inform the Court of her decision. September 18, 2017 Opinion or Order Filing 137 OPINION & ORDER PARTIALLY ADOPTING REPORT AND RECOMMENDATION re: 111 MOTION for Summary Judgment . filed by American Sugars Holdings Inc., Bob Jandovitz and 132 REPORT AND RECOMMENDATIONS. For the foregoing reasons, regarding Plai ntiff's Title VII and NYSHRL claims, the Court adopts the R&R's recommendation to grant Defendants summary judgment on the claims against Jandovitz; adopts the R&R's recommendation to deny Defendants' motion respecting the hosti le work environment claim against ASH; and sustains Defendants' objections regarding the discrimination and retaliation claims against ASH. Accordingly, the Court GRANTS summary judgment in favor of Defendants on Plaintiff's Title VII a nd NYSHRL claims against Jandovitz; DENIES summary judgment to Defendants onPlaintiff's Title VII and NYSHRL hostile work environment claim against ASH; and GRANTS summary judgment in favor of Defendants on Plaintiff's Title VII and NYSH RL discrimination and retaliation claims against ASH. The Court dismisses Plaintiff's NYCHRL claims as the City law has no application outside New York City's limits. The parties are directed to appear at a status conference at 10:30 a.m. on October 12, 2017 in Courtroom 14C to set a date for trial. The Clerk of Court is directed to terminate all pending motions.
