Filing 59 OPINION AND ORDER re: 42 MOTION for Summary Judgment filed by Campbell, Murphy, Boykin, Brian Fischer, L. Smith, Robinson. For the foregoing reasons, Defendants' motion for summary judgment is granted in part and denie d in part. Cox's claims against Defendants Fischer, Campbell, Smith, Robinson, and Boykin are dismissed. Cox's excessive force claim against Defendant Murphy survives. The Court notes that the exhibits to the Declaration of Michael J. Kea ne (Dkt. 4 7), which include the transcripts of Cox's depositions, do not appear to have been filed on the public docket. No later than April 6, 2017, Defendants shall publicly file the exhibits on the docket or submit a letter setting forth the basis for sealing or redacting these exhibits under Lugosch v. Pyramid Co. of Onondaga, 435 F.3d 110 (2d Cir. 2006). A conference is hereby scheduled for April 13, 2017 at 4:00 p.m. in Courtroom 1506 at the United States Courthouse, 40 Foley Sq uare, New York, New York 10007. The Clerk of Court is respectfully directed to terminate the motion pending at Docket No. 42. (As further set forth in this Order.) Brian Fischer (DOCCS), Robinson, L.
