Filing 11 JOINT STIPULATION AND ORDER REGARDING SERVICE OF PROCESS AND SCHEDULE OF PROCEEDINGS: The parties to the above-captioned action hereby agree and stipulate to the following: 1. Pursuant to 28 U.S.C. §1407, defendant National Hockey League ("NHL" or "Defendant") has filed a motion before the Judicial Panel on Multidistrict Litigation ("JPML") to transfer this action to the U.S. District Court for the District of Columbia for coordinated pretrial proceedings with Leeman v. NHL, No. 1:13-CV-01856 (D.D.C. 2013) ("Leeman") and Christian v. NHL, No. 14-cv-01140-SRN-JSM (D. Minn. 2014) ("Christian"). The JPML has set a briefing schedule in which responses to the NHL' s motion are due on May 16, 2014. 2. Defendant agrees to accept service of the Corrected Class Action Complaint ("Corrected Complaint") filed in the above-captioned matter (Dkt. No. 4) through its attorneys, whose signatures appear below. Service shall be deemed to be accepted as of May 1, 2014. By authorizing its counsel to accept service on its behalf, the NHL is not waiving any defense other than insufficient process and insufficient service of process (Rules 12(b)(4) and (5) of the Federal Rules of Civil Procedure), and the NHL expressly reserves all other defenses, including but not limited to any and all defenses related to jurisdiction and venue. 3. All matters and proceedings in this action shall be stayed pending the JPML's decision on whether to transfer this action for coordinated pretrial proceedings with Leeman and Christian. If the JPML declines to transfer this action for coordinated pretrial proceedings with Leeman and Christian, or the JPML selects this Court as the transferee court, the parties will thereafter confer on a schedule of proceedings, including the time by which the Defendant must move, answer or otherwise plead in response to the Corrected Complaint or any consolidated complaint. 4.
