Lima, Department of Corrections and Community Supervision, New York State Department of Corrections and Community Supervision. Defendants' motion for summar y judgment is GRANTED, and Nunez's claims are dismissed, albeit without prejudice to her refiling the NYCHRL retaliation and harassment claims in state court. The Clerk of Court is directed to terminate Docket No. 46, to close this case, and to mail a copy of this opinion to Nunez, and as further set forth herein. (Signed by Judge Jesse M. July 31, 2015 Opinion or Order Filing 18 OPINION AND ORDER re: 10 MOTION to Dismiss filed by Joseph A. Lima, New York State Department of Corrections and Community Supervision. For the foregoing reasons, Defendants' motion to dismiss is GRANTED in part and DENIED in part. Spe cifically, the Court dismisses Plaintiff's sexual harassment claims under Title VII and the NYSHRL; all of Plaintiff's hostile work environment claims; and all of her NYSHRL and NYCHRL claims against DOCCS. Plaintiff's sexual harassme nt and retaliation claims against Lima under the NYCHRL, her Title VII retaliation claim against DOCCS, and her NYSHRL retaliation claim against Lima, on the other hand, are sufficient to survive Defendants' motion to dismiss. The Clerk of Court is directed to terminate Docket No. 10 and to mail a copy of this Opinion and Order to Plaintiff. (As further set forth in this Order.) (Signed by Judge Jesse M.
