OPINION AND ORDER re: 154 MOTION for Summary Judgment, filed by John Jankovic, 150 MOTION for Summary Judgment, filed by Sandra Dyche. The Court DENIES Defendants' motions for summary judgment as to Plaintiff Yu. Although Plaintiff Kim has withdrawn his Section 10(b) and Rule 10b-5 claims against Defendants, the Court retains pendent jurisdiction over Plaintiff Kim's state-law claims. The Clerk of Court is directed to terminate the motions at Docket Entries 150 and 154. The parties are hereby ORDERED to appear for a status conference on February 14, 2018, at 4:00 p.m., in Courtroom 618 of the Thurgood Marshall Courthouse, 40 Foley Square, New York, New York, at which time trial will be scheduled. OPINION AND ORDER: For the reasons set forth above, the Court GRANTS IN PART, and DENIES IN PART, the SEC's motion for summary judgment. The Clerk of Court is ORDERED (i) to terminate Docket Entry 47 and (ii) docket this Opinion in Yu v. Premier e Power LLC, 14 Civ. 7588 (KPF), as well as the docket for this case. On July 18, 2016, this Court stayed Yu v. Premiere Power LLC, 14 Civ. 7588 (KPF), pending resolution of the SEC's motion for summary judgment in this matter. Accordingly, that stay is hereby LIFTED. The parties in that case and the instant case are ORDERED to file a joint status letter (in the dockets of both cases) on or before April 3, 2017.
