Therefore this case is moot. See, e.g., Harvey v. Holder, 63 F. Supp. 3d 318, 320-21 (W.D.N.Y. 2014) (dismissing habeas petition as moot where petitioner only sought relief from custody and was released); Johnson v. Reno, 143 F. Supp. 2d 389, 391 (S.D.N.Y. 2001) ("A habeas corpus petition seeking release from [ICE] custody is moot when the petitioner is no longer in [ICE] custody."). Accordingly, the petition is dismissed.
