Filing 33 MEMORANDUM OPINION & ORDER: The motion to dismiss is GRANTED with prejudice as to all of plaintiff's claims under the Eighth Amendment. The motion to dismiss is also GRANTED with prejudice as to plaintiffs claim under the Due Process Clause rela ting to his confinement in punitive segregation following his disciplinary proceeding. The motion to dismiss is GRANTED as to all of plaintiff's remaining claims for monetary damages. The motion to dismiss plaintiff's claims for injunctive relief from his continued confinement in ESH, and for access to religious services, is GRANTED without prejudice as to all defendants except Ponte, against whom the motion to dismiss these two claims for injunctive relief is DENIED.
