OPINION & ORDER re: 15 MOTION to Dismiss Complaint, filed by Karl Vollmer, S. Carden, Lopez, Westchester County Department of Correction. The Motion is granted without prejudice. Should Plaintiff wish to amend his Complaint, he mu st do so within 30 days of the date of this Order. If Plaintiff does not file an Amended Complaint within that time, his Complaint will be dismissed with prejudice and the case will be closed.
