Exec. Law § 296(2)(a); and New York City Human Rights Law, N.Y.C. Admin. Code § 8-107. Defendant moves to dismiss the complaint pursuant to Federal Rule of Civil Procedure 12(b)(6). For the reasons stated above, defendant's motion to dismiss is granted. This opinion and order resolves the motion numbered 12 on the docket.
