OPINION AND ORDER re: 33 MOTION for Summary Judgment filed by Carlos Almonte, 39 CROSS MOTION for Summary Judgment filed by Elias Chacon, Gilberto Rodriguez: Carlos Almonte brings this action pursuant to 42 U.S.C. § 1983 and New York State law against New York State Police ("NYSP") Investigators Gilberto Rodriguez and Elias Chacon (together, "Defendants"). Plaintiff asserts claims for, among other things, false arrest and malicious prosecution in violati on of his Fourth Amendment rights. Before the Court are Plaintiff's and Defendants' cross-motions for summary judgment. For the reasons set forth above, Defendants' motion for summary judgment is GRANTED in full and Plaintiff's motion is DENIED.
