The defen dants move to dismiss the plaintiffs' First Amended Complaint under Rule 12(b)(6) of the Federal Rules of Civil Procedure. LNR moves to dismiss the defendants' third party complaint. (As further set forth in this Order.) For the reasons s et forth above, the defendants' motion to dismiss the First Amended Complaint pursuant to Federal Rule of Civil Procedure 12(b)(6) is denied. The third party defendant's motion to dismiss the third party complaint pursuant to Federal Rule of Civil Procedure 12(b)(6) is granted.
