Kenney, The Trustees of Columbia University in the City of New York, Lucinda Durning, Louis Bellardine, William L. Innes, Columbia University. For the foregoing reasons, defendant's motion to dismiss is GRANTED in part and DENIED in part. Counts I, II, IV, VI and VII are dismissed in their entirety.
