For the reasons stated above, the Court concludes that Unum has met its burden of establishing that the deferential abuse of discret ion standard of review applies to the denial of Tietjen's claim. Accordingly, Tietjen's motion seeking an order declaring that the appropriate standard of review in this action is de novo is DENIED. Counsel shall promptly confer with resp ect to the next steps in this litigation and, within two weeks of the date of this Memorandum Opinion and Order, shall submit a joint letter detailing their views and whether a conference is necessary.
