OPINION AND ORDER: re: 16 MOTION to Remand to State Court filed by D.A. For the foregoing reasons, the Court concludes that it lacks subject matter jurisdiction over this case. The motion to remand the action is accordingly GRANTED. The case is remanded to New York State Supreme Court, Bronx County.
