MEMORANDUM OPINION AND ORDER: re: 35 AMENDED MOTION to Dismiss Amended Notice of Motion filed by Joseph Ponte, Bill De Blasio, New York City Department of Correction, City of New York. For the foregoing reasons, Defendants' motion to dismiss the Complaint is granted in its entirety. This dismissal is without prejudice to the filing of a motion pursuant to Federal Rule of Civil Procedure 15(a) for leave to amend the Complaint. Any such motion must be filed by July 2, 2018 and m ust be accompanied by a memorandum of law and a copy of the proposed amended complaint that is blacklined to identifythe proposed changes. Failure to make a timely motion for leave to amend, or to demonstrate in such a motion that amendment would not be futile, will result in dismissal of this action with prejudice and without further advance notice.
