Filing 191 MEMORANDUM OPINION AND ORDER: re: 171 MOTION for Summary Judgment as to Plaintiff's causes of actions against Tyco. filed by Tyco Fire Products LP. In light of the foregoing, because Plaintiff's claims for relief against Defe ndant are preempted by the HMTA, Defendant's motion for summary judgment is GRANTED and the Amended Complaint is DISMISSED. Notwithstanding the fact that Plaintiff's claims for relief have been dismissed, the third-party action between Defendant and Oprandy's remains pending, although Defendant indicated on the record during oral argument a willingness to abide the result of this motion.
