June 19, 2018 Opinion or Order Filing 27 ORDER OF DISCONTINUANCE: The Court having been advised by the parties that all claims asserted herein have been settled in principle, Dkt. 26, it is ORDERED that the above-entitled action is hereby dismissed and discontinued without costs, and without prejudice to the right to reopen the action within thirty days of the date of this Order if the settlement is not consummated. To be clear, any application to reopen must be filed within thirty days of this Order; any application to reopen filed thereafter may be denied solely on that basis. Further, if the parties wish for the Court to retain jurisdiction for the purposes of enforcing any settlement agreement, they must submit the settlement agreement to the Court within the same thirty-day period to be "so ordered" by the Court. Per Paragraph 4(C) of the Court's Individual Rules and Practices for Civil Cases, unless the Court orders otherwise, the Court will not retain jurisdiction to enforce a settlement agreement unless it is made part of the public record. April 30, 2018 Opinion or Order Filing 20 ORDER granting in part #19 Letter Motion for Extension of Time to Complete Discovery. Granted in part. The Court will not extend the discovery deadlines by the two months the parties request. The parties present no justification for such an extension other than their inability to complete discovery within the four-month period provided in the case management plan. Moreover, the parties' own revised case management plan calls for depositions to be completed by May 3, 2018. As depositions appear to be the only significant discovery task still outstanding, it makes little sense to extend discovery for two months beyond that proposed deadline for the completion of depositions. To ensure, however, that depositions are completed without incident, the Court will grant a two-week extension of the fact discovery deadline, i.e. to May 17, 2018. The Court believes no extension of the expert discovery deadline is warranted at this time.
