September 9, 2019 Opinion or Order Filing 154 MEMORANDUM OPINION AND ORDER re: 92 MOTION for Summary Judgment . filed by The Wattstopper, Inc., 97 MOTION for Summary Judgment . filed by Automated Irrigation Controls, LLC. For the reasons articulated above, Watt Stopper's motion for summary judgment as to the Complaint is GRANTED IN PART and DENIED IN PART, and AIC's motion for summary judgment as to the Counterclaims DENIED. Watt Stopper is granted summary judgment as to AIC's claims to the extent those claims any are reliant on a determination that any given product is a "functionally equivalent successor product." Watt Stopper is also granted summary judgment as to AIC's claims to the extent those claims relate to produ cts bearing the model numbers LMDL-600, LMPC-600, and LMPX-600. In all other respects, the parties' motions for summary judgment are denied. The Court understands that Watt Stopper's counterclaim for declaratory judgment that Pike is obliga ted to return all Watt Stopper property in his possession, custody, or control is no longer germane. The Clerk of Court is directed to terminate the motions pending at Dkt. Nos. 92 and 97. SO ORDERED. (Signed by Judge Gregory H. Woods on 9/9/2019) (kv)
