October 25, 2022 Opinion or Order Filing 144 ORDER OF DISMISSAL: It is hereby ORDERED that: 1. The Court finds that the terms of the proposed settlement agreement are fair, reasonable, and adequate, both to redress Plaintiff's claims in this action and to compensate Plaintiff&# 039;s counsel for their legal fees, and the agreement is therefore approved. 2. In accordance with the proposed settlement agreement, the Southern District of New York will retain jurisdiction over this matter for the purpose o f enforcing the settlement agreement, if necessary. 3. As a result of the Courts approval of the parties' proposed settlement, this action is hereby discontinued with prejudice and without costs, provided, however, that, wit hin 30 days of the date of this Order, if any aspect of written documentation of the settlement is not completed, then Plaintiff may apply by letter for the restoration of the action to the active calendar of the Court. 4. August 15, 2022 Opinion or Order Filing 138 ORDER: On August 11, 2022, the Mediator in this case reported to the Court that that the court-ordered mediation in this case was held and agreement was reached on all issues. Accordingly, it is hereby: ORDERED that this action be conditio nally discontinued without prejudice and without costs; provided, however, that within thirty (30) days of the date of this Order, the parties may submit to the Court their own Stipulation of Settlement and Dismissal for the Court to So Order. Oth erwise, within such time Plaintiff may apply by letter for restoration of the action to the active calendar of this Court in the event that the settlement is not consummated. Upon such application for reinstatement, the parties shall continue to b e subject to the Courts jurisdiction, the Court shall promptly reinstate the action to its active docket, and the parties shall be directed to appear before the Court, without the necessity of additional process, on a date within ten (10) days of the application, to schedule remaining pretrial proceedings and/or dispositive motions, as appropriate. This Order shall be deemed a final discontinuance of the action with prejudice in the event that Plaintiff has not requested restoration of th e case to the active calendar within such 30-day period.
