Filing 18 ORDER granting in part and denying in part #17 Letter Motion for Conference. Application granted in part and denied in part. On August 20, 2018 Defendant's requested a pre-motion conference to discuss their potential motion to dismiss. Dkt. No. 9. That conference was held on August 24, 2018. On August 24, 2018, for reasons stated at the conference, the Court accepted the withdrawal of Defendants' request for leave to file a motion to dismiss, and wrote that "Defendant's may renew their request for leave to file a motion to dismiss by letter... [t]he Court will not require an additional pre-motion conference to discuss Defendants' potential renewed motion to dismiss." Dkt. No. 15. Accordingly, to the extent that this letter requests leave to file a motion to dismiss, the application is GRANTED. Defendants must file their motion no later than September 21, 2018. Any opposition must be filed no later than three weeks after the filing of the motion to dismiss. Defendant's reply, if any, must be filed no later than one week after the filing of Plaintiff's opposition. To the extent that this letter requests a pre-motion conference regarding a potential motion for sanctions under Federal Rule of Civil Procedure 11, or leave to file such a motion, the application is DENIED. Rule 11(c)(2) explains that a motion for sanctions "must be served under Rule 5, but it must not be filed or be presented to the court if the challenged paper, claim, defense, contention, or denial is withdrawn or appropriately corrected within 21 days after service or within another time the court sets." The Court expresses no opinion on the adequacy of the correspondence filed at docket numbers 17-1 and 17-2 under Rule 11(c)(2), but notes that Plaintiff's amended complaint was filed on August 31, 2018, (Dkt. No. 16). Accordingly, the Court's involvement in any Rule 11 motion practice related to the amended complaint is premature at this time. SO ORDERED. (Signed by Judge Gregory H.
