ORDER REGARDING E-DISCOVERY AND ELECTRONICALLY STORED INFORMATION ("ESI"): This Order regarding E-Discovery and Electronically Stored Information ("ESI")("ESI Order") shall govern the production of documents and electronically stored information ("ESI") by the parties in the above-captioned litigation. The ESI Protocol shall also govern productions made by any third party who is subpoenaed in this action unless otherwise agreed to by the issuing party and the third party. General production requests under Federal Rules of Civil Procedure 34 and 35, or compliance with a mandatory disclosure order of this court, shall not include e-mail or other forms of electronic correspondence (collectively "e-mail"). To obtain e-mail production parties must propound specific e-mail production requests in accordance with this ESI Order. Except as expressly stated herein nothing in this ESI Order affects the parties' or third parties' discovery obligations under the Federal or Local Rules as further set forth herein.
