September 26, 2022 Opinion or Order Filing 130 ORDER OF DISMISSAL The Court having been advised at ECF No. 128 that all claims asserted herein have been settled in principle, it is ORDERED that the above-entitled action be and is hereby DISMISSED and discontinued without costs, and without prejudice to the right to reopen the action within thirty days of the date of this Order if the settlement is not consummated. To be clear, any application to reopen must be filed by the aforementioned deadline; any application to reopen filed thereafter may be denied solely on that basis. If the parties wish for the Court to retain jurisdiction for the purposes of enforcing any settlement agreement, they must submit the settlement agreement to the Court by the deadline to reopen to be "so ordered" by the Court. Per Paragraph 4(C) of the Court's Individual Rules and Practices for Civil Cases, unless the Court orders otherwise, the Court will not retain jurisdiction to enforce a settlement agreement unless it is made part of the public record. September 21, 2022 Opinion or Order Filing 127 ORDER It is hereby ORDERED that counsel for all remaining parties shall appear for a Final Pretrial Conference on September 28, 2022 at 10:00 AM in Courtroom 20B of the Daniel Patrick Moynihan Courthouse, 500 Pearl Street, New York, New York. The Final Pretrial Conference must be attended by the attorney who will serve as principal trial counsel. The parties are excused from the Court's requirement of filing a Joint Pretrial Order as the Court will rely on the parties' previously filed Joint Pretrial Order at ECF No. 84. (See Rochon Individual Rules at 5(A).) The parties are also excused from filing proposed jury instructions, verdict form, and voir dire questions as the prior final instructions, form and questions from the prior trial will be used. For the reasons stated at today's conference and will be articulated further, IT IS HEREBY ORDERED that: Defendants' motion in limine is granted. Plaintiff's motion in limine is granted in part and denied in part. The Court grants Plaintiff's motion with respect to testimony regarding the following subjects: (1) Ms. Ajasin's 2001 participation in a class action lawsuit related to potential asbestos exposure; (2) her prior ticket for using a cell phone while driving; (3) the suspension of her license due to an outdated registration; and (4) her participation in an accident-prevention course. The deadline for the service of any requests for admission ("RFA") has been extended to June 28, 2020. As for defendants' request for a certification or affidavit related to plaintiff's social media accounts, that request is denied and defendants are directed to utilize plaintiff's continued deposition and potential RFAs to confirm any facts related to the scope and use of her social media. In addition, as directed at the conference, plaintiff's response to defendants' January 8, 2020 document request is due no later than March 16, 2020. Failure to comply with this order could result in sanctions. Finally, plaintiff agreed to provide the three authorizations defense counsel identified related to the December 10, 2019 document request, but the remaining requests are hereby deemed withdrawn and defendants will determine what additional authorizations, if any, may be needed following the service of additional RFAs and the completion of plaintiff's deposition.
