May 4, 2022 Opinion or Order Filing 58 ORDER OF DISMISSAL: The Court having been advised by counsel's letter dated May 4, 2022 (Dkt. No. 55)that all claims asserted herein have been settled, it is hereby ORDERED that theabove-entitled action be and is hereby dismissed and discont inued without costs, but without prejudice to the right to reopen the action within 30 days of the date of this Order if the settlement is not consummated. To be clear, any application to reopen must be filed within 30 days of the date of this Ord er; any application to reopen filed thereafter may be denied solely on that basis. Further, if the parties wish for the Court to retain jurisdiction for the purposes of enforcing any settlement agreement, they must submit the settlement agreement to the Court within the same 30-day period to be "so ordered" by the Court. November 16, 2021 Opinion or Order Filing 44 ORDER: The Court held a status conference today, at which it set the following schedule: 1. All pre-trial papers, including a joint pre-trial order, proposed voir dire,requests to charge, and any motions in limine must be submitted by January 21, 2022. Opposition papers to any motions in limine are due by February 4, 2022. Any reply papers will be due by February 11, 2022. 2. A final pre-trial conference will take place on April 6, 2022 at 11:00 a.m., at which the Court will, if possible, reconfirm the trial date, make any rulings on pending motions (if it has not done so before the conference), and discuss logistical issues related to the trial. This conference will be held in-person in courtroom 21-D, 500 Pearl Street, New York , NY. 3. Subject to reconfirming once courtroom availability is determined, trial will take place beginning on May 9, 2022. The Court will block out the entire week of May 9-13 as, given the number of witnesses expected to testify, the Court antic ipates no longer than a five-day trial. SO ORDERED. August 4, 2021 Opinion or Order Filing 39 ORDER: The Court held a telephone conference today at which it set the following schedule: Defendants' application to produce an expert report beyond the April 2021 deadline set in the case management schedule is due by August 17, 2021. Plain tiff's opposition is due by August 31, 2021. Unless it believes a further conference is necessary, the Court will decide this application on the papers. Plaintiff's motion for summary judgment on the issue of liability is due October 1, 20 21. Defendants' opposition is due November 1, 2021. Plaintiffs' reply is due November 15, 2021. July 21, 2021 Opinion or Order Filing 38 ORDER: Pursuant to the Court's order dated June 23, 2021 (Dkt. No. 36), the parties were directed to advise the Court within 7 days of the conclusion of the mediation in order for the Court to schedule a status conference in the event the part ies did not resolve the case. The Mediation Office filed its final report on July 12, 2021 indicating that the mediation had been unsuccessful. Dkt. No. 37. To date, the parties have not filed an update.
