STIPULATION: IT IS HEREBY STIPULATED AND AGREED, by and between the undersigned, the attorneys of record for the plaintiffs Lee Godrey and Yun Jae Chung ("Plaintiffs") and defendant Executive Risk Indemnity Company (improperly pleaded as "Chubb Insurance, Ltd." and "the Chubb Corporation") ("Executive Risk"), that the First Cause of Action of Plaintiffs' Complaint alleging Bad Faith against Executive Risk be and hereby is dismissed with prejudice; and IT IS FURTHER STIPULATED AND AGREED that the caption of this action shall be amended to correctly identify the Plaintiffs as "Lee Godfrey and Yun Jae Chung" and the defendant as "Executive Risk Indemnity Company". IT IS FURTHER STIPULATED AND AGREED that Executive Risk shall file an Answer to the remainder of Plaintiffs' Complaint within twenty (20) days of the entry of this Stipulation.
