February 5, 2021 Opinion or Order Filing 13 ORDER TO ANSWER, 28 U.S.C. 2254: Having examined this petition under 28 U.S.C. 2254, the Court hereby ORDERS that: The Clerk of Court shall serve a copy of this Order, the petition (Dkt. #1), and four subsequently filed letters (Dkt. #3, 5, 7, 10) on the Attorney General of the State of New York by certified mail to 28 Liberty Street, New York, New York, 10005; and on the District Attorney of New York County by certified mail to One Hogan Place, New York, New York 10013. January 26, 2021 Opinion or Order Filing 9 ORDER DIRECTING PRISONER AUTHORIZATION: The Court is in receipt of Petitioner Darryl Phelps's application to proceed in forma pauperis (IFP). If the Court grants a prisoner's IFP application, the Prison Litigation Reform Act requires the Court to collect the $350.00 filing fee in installments deducted from the prisoner's account. See 28 U.S.C. 1915(b)(1). A prisoner seeking to proceed in this Court without prepayment of fees must therefore authorize the Court to withdraw these payments from his account by filing a prisoner authorization, which directs the facility where the prisoner is incarcerated to deduct the $350.00 filing fee1 from the prisoner's account in installments and to send to the Court certified copies of the prisoner's account statements for the past six months. See 28 U.S.C. 1915(a)(2), (b). The required authorization form is attached to this Order for Petitioner's use, if he so desires. Petitioner is directed to submit the required authorization form on or before February 9, 2021, labeled with docket number 20 Civ. 10352 (KPF). If the Court grants the IFP application, Petitioner will be permitted to proceed without prepayment of fees. See 28 U.S.C. 1915(a)(1). January 14, 2021 Opinion or Order Filing 6 ORDER DIRECTING PAYMENT OF FEE OR IFP APPLICATION: The Court is in receipt of Petitioner Darryl Phelps's letter dated January 7, 2021. (Dkt. #5). By Order dated December 29, 2020, Petitioner was advised that to proceed with his petition for a writ of habeas corpus in this Court, he must either pay the $5.00 filing fee or, to request authorization to proceed in forma pauperis (IFP), submit a signed IFP application. The Court also indicated that if Petitioner fails to either pay the filing fee or submit a signed IFP application within the time allowed, the action will be dismissed. The Court reiterates those requirements here and extends Petitioner's response deadline to February 4, 2021. An IFP application is attached to this Order for Petitioner's use, if he so desires. If Petitioner submits the IFP application, it should be labeled with docket number 20 Civ. 10352 (KPF).
