STIPULATION AND ORDER OF DISMISSAL WITHOUT PREJUDICE: IT IS HEREBY STIPULATED AND AGREED by and between the undersigned parties, by their respective counsel, pursuant to Federal Rule of Civil Procedure 4l(a)(2), as follows: The United States of America is substituted as defendant in place of Joel Bumol. Plaintiff's claims against the United States of America in this action are dismissed without prejudice. This action is hereby remanded to the Supreme Court of the State of New York, County of Bronx, as there is no longer federal subject matter jurisdiction due to the dismissal of the United States of America. All conferences are canceled. All motions are moot. Counsel for the United States shall promptly serve a copy of this Order on all parties and file proof of service within two business days of the date of this Order. The Clerk of Court is directed to remand this case to the Supreme Court of the State of New York, County of Bronx, and to close the case in this Court. SO ORDERED., (United States Of America added.
