December 16, 2021 Opinion or Order Filing 24 STIPULATION OF VOLUNTARY DIMISSAL WITH PREJUDICE AND WITHOUT COSTS AND DISSOLUTION OF TEMPORARY RESTRAINING ORDER: IT IS HEREBY STIPULATED AND AGREED, by and between counsel for the respective undersigned parties, as follows: 1. The above-captioned action is hereby dismissed with prejudice and without costs to either side pursuant to Fed. R. Civ. P. 41(a)(l)(A)(ii). 2. The Order to Show Cause Why a Preliminary Injunction Should Not Be Issued Under Fed. R. Civ. P. 65(b) entered in this case on December 10, 2021 (Docket No. 11) (the "TRO") is hereby dissolved and the hearing scheduled for December 22, 2021 is cancelled. 3. The restraints set forth in the TRO are accordingly lifted and Defendants' banking institutions are authorized and directed to release any accounts held by virtue of the TRO. 4. P. 65, defendants, their officers, agents, servants, employees, and all other persons who are in active concert or participation with the same are temporarily enjoined and restrained from alienating, dissipating, paying over or assigning any assets of 1520, or its subsidiaries or related companies, except for payment to Plaintiff, until further order of this Court or until defendants pay Plaintiff the amount of $105,646.81 by bank check or wire transfer, at which time this Order is dissolved; and it is further ORDERED that (As further set forth herein.) and it is further ORDERED ORDERED that service of a copy of this order and the papers upon which it is based, together with the summons and complaint, by Federal Express or other nationally recognized overnight delivery service upon the defendants on or before December 14, 2021, shall be deemed good and sufficient service thereof; and it is further ORDERED that answering papers, if any shall be served by defendants so as to be received by Plaintiff's counsel at least 48 hours prior to the return date set forth herein.
