For the foregoing reasons, the Court ADOPTS the R&R in its entirety, and Plaintiff's motion for a temporary restraining order and preliminary injunction is DENIED. Further, the Court finds no merit in Plaintiff's objections to the R&R's resolution of the motion to amend, and, therefore, those objections are OVERRULED. May 19, 2022 Opinion or Order Filing 33 ORDER granting in part and denying in part #32 Letter Motion for Extension of Time. The City's Letter Motion filed at ECF No. 32 is GRANTED IN PART and DENIED IN PART. Regarding the City's statement that "Plaintiff has since indicated that he no longer consents to proceeding before a Magistrate [Judge]," the Court notes that Plaintiff never consented to a Magistrate Judge. Rather, Judge Torres referred this case to the undersigned for general pretrial purposes and to make a report and recommendation to her with respect to certain of Plaintiff's motions. (Am. Order of Ref., ECF No. 23.) On 1/28/2022, the undersigned, as part of the general pretrial referral, ordered that "Plaintiff may, within fourteen (14) days, file a Second Amended Complaint adding only Avo Shopping Company as a defendant, but not Valtzer, Thomas and Rodriguez." (ECF No. 25.) (The undersigned also made a recommendation on the same date, in the same document, with respect to Plaintiff's motion for injunctive relief. (Id.)) On 1/30/2022, Plaintiff filed what can be construed as objections to the undersigned's Order regarding Plaintiff's Second Amended Complaint, and to his recommendation regarding injunctive relief. (ECF No. 26.) Judge Torres has not yet acted on Plaintiff's objections. On 2/17/2022, Plaintiff filed a "Proposed Amended Complaint" that is not in compliance with the Court's Order, because it names as defendants Valtzer, Thomas and Rodriguez. (ECF No. 27.) Plaintiff also improperly named as a defendant former Mayor DiBlasio, who on 1/7/2022 was terminated from the case. (ECF No. 7.) Thus, Plaintiff's document filed at ECF No. 27 is a nullity. Pending Judge Torres' decision regarding Plaintiff's objections, the time for Defendants to respond to any of Plaintiff's pleadings is adjourned sine die. After Judge Torres rules on Plaintiff's objections, the Court shall set a schedule for Plaintiff to file any amended pleading, in compliance with the Court's Orders, and for Defendants to respond. January 21, 2022 Opinion or Order Filing 18 ORDER: By Order, dated January 20, 2022 (see Am. Order of Ref., ECF No. 17), Plaintiff's letter, dated January 20, 2022, seeking to amend his complaint for a second time1 (see Pl.'s 1/20/22 Ltr., ECF No. 15), was referred to the undersigned for disposition. In his January 20 letter, Plaintiff requests that "he be allowed to amend his filing, adding Avo Shopping Company to the instant action." (See id.) The Court construes Plaintiffs letter as a motion to amend, pursuant to Rule 15 of the Federal Rules of Civil Procedure. For the reasons set forth below, Plaintiff's motion is DENIED WITHOUT PREJUDICE. It is a "general rule that a motion to amend must be accompanied by a proposed amended pleading." See Taylor v. Trigeno, No. 16-CV-01143 (GHW), 2021 WL 6070444, at *3 (S.D.N.Y. Dec. 21, 2021). A copy of the proposed amended complaint must accompany the motion so that the Court can understand the exact changes sought, see In re Crude Oil Commodity Litig., No. 06-CV- 06677 (NRB), 2007 WL 2589482, at *4 (S.D.N.Y. Sept. 8, 2007), as well as the relief sought as to each of the defendants. Thus, if Plaintiff wishes to be granted leave to file another amended pleading, he shall file a proposed Second Amended Complaint no later than January 28, 2022. SO ORDERED.
