STIPULATION PERMITTING AMENDMENT OF PLAINTIFF'S COMPLAINT: IT IS HEREBY STIPULATED by and between the parties to the above-captioned litigation as follows: 1. Plaintiff J&A Concrete Corp. ("J&A") intends to amend its Complaint [Dkt. 1] filed in this action (the Amended Complaint). 2. The deadline to move or otherwise stipulate to the filing of the Amended Complaint is October 31, 2022 [Dkt. 54]. 3. The parties hereby stipulate to J&A filing an Amended Complaint. 4. Defendants Dobco Inc. and Arch Insurance Company shall have thirty (30) days from the date of filing the Amended Complaint to respond to the Amended Complaint. 5. All parties reserve all rights, remedies, claims, and defenses with regard to the proposed amended pleadings contemplated by this Stipulation, including specifically but without limitation any defense predicated upon the assertion that the Amended Complaint or any causes of action therein contained fail to state a claim cognizable at law or are otherwise subject to dismissal as a matter of law. ORDER. Plaintiff has requested a pre-motion conference in order to discuss amending its complaint to add additional causes of action. Plaintiff reports that it conferred with counsel for Arch Insurance and Dobco regarding its intent to file an amended complaint and proposed a stipulation for the parties to agree to the filing of the amended complaint with a thirty (30) day time period for the Defendants to file their response to the same. However, at the time plaintiff filed its letter-motion, counsel for the Defendants had not responded with agreement to the proposed stipulation, thus requiring the request for a pre-motion conference. Defendants are therefore directed to respond to plaintiff's letter-motion no later than November 7. If the parties can agree on a stipulation, then the need for a conference will be obviated.
