MEMO ENDORSEMENT on re: #13 Letter filed by The Province of Buenos Aires. ENDORSEMENT: Application DENIED. Although this case and the earlier-filed action, Glacial Capital, LLC et al v. The Province of Buenos Aires, No. 21 Civ. 10786 (the "first action"), "concern the same... parties" and "there is substantial factual overlap," see Rules for the Division of Business Among District Judges, S.D.N.Y., Rule 13(a)(1), the first action has been closed since Judge Vyskocil entered judgment on May 20, 2023, see No. 21 Civ. 10786, ECF No. 57. Accordingly, there is no meaningful risk that "the parties could be subjected to conflicting orders" or that, "absent a dete1mination of relatedness[,] there would be a substantial duplication of effort and expense, delay, or undue burden on the court, parties, or witnesses." Rule 13(a)(1)(D). Under these circumstances, the Court declines to seek a transfer of this case on consent to Judge Vyskocil. SO ORDERED. (Signed by Judge Jennifer H. Rearden on 6/21/2024) (tg)
