Filing 131 OPINION & ORDER re: 113 MOTION for Summary Judgment filed by Aaron Hess, 110 MOTION for Summary Judgment filed by The Village of Pleasantville, New York. For the foregoing reasons, Defendants' Motions are grant ed in part and denied in part. Plaintiff's Fourth Amendment claims are dismissed. Plaintiff's Fourteenth Amendment claim and state law assault and battery claims will go forward. Plaintiff's claims against the John Doe Defendants are d ismissed without prejudice. The Court will hold a conference on October 30, 2017, at 2:00 PM to discuss the status of the case. The Clerk of Court is respectfully directed to terminate the pending Motions. (See Dkt.
