MEMORANDUM OPINION AND ORDER re: 30 MOTION for Summary Judgment and/or to preclude filed by Metro-North Commuter Railroad. For the reasons stated above, Defendant's motion for summary judgment is DENIED. Defendant's motion to preclude expert testimony is DENIED without prejudice to renewal as a motion in limine.
