March 31, 2014	Filing 19 OPINION AND ORDER: Defendant's Motion to Dismiss is granted in part and denied in part. Plaintiff's claim that Defendant willfully violated Section 1681b(f) is dismissed without prejudice, while Plaintiff's claim that Defendant neglige ntly violated Section 1681b(f) survives, for the time being. Plaintiff may file a Second Amended Complaint within 30 days of the issuance of this Opinion, which Complaint may address the deficiencies that the Court has identified. Should Plaintiff fa il to do so, his claim that Defendant willfully violated Section 1681 b(f) will be dismissed with prejudice for failure to state a claim upon which relief can be granted. Should Plaintiff file a Second Amended Complaint, Defendant will have 20 days either to answer or to submit a premotion letter. The Clerk is respectfully directed to terminate the pending Motion.
